Divorce in Macedonia — What You Need to Know
Divorce is one of the most difficult decisions in life. Beyond the emotional burden, the process involves a series of legal issues that must be resolved — from property division to child custody. In this article, we explain the basics you need to know if you are considering divorce in North Macedonia.
Two Types of Divorce
Macedonian law recognizes two types of divorce:
- Consensual divorce — Both spouses agree to the divorce and all key issues (property, children, alimony). This is a faster and simpler process, usually taking 1-3 months.
- Contested divorce — When one party disagrees or there are unresolved issues. This process can take over a year and involves court proceedings.
Property Division
Property acquired during the marriage is considered joint property and is divided equally between spouses. Property that one spouse owned before the marriage or received as a gift/inheritance remains their personal property.
It is important to know that the division can be agreed upon amicably or decided by the court. We recommend engaging a lawyer to protect your rights.
Child Custody
In divorce cases involving minor children, the court decides on custody guided by the best interest of the child. Factors considered include:
- The age of the child
- The emotional bond with each parent
- Living conditions with each parent
- The wishes of the child (if old enough)
Alimony
The parent without custody is obligated to pay alimony (maintenance) for the child. The amount is determined based on the needs of the child and the financial capabilities of the parent. Alimony can be modified if circumstances change.
