Child Custody After Divorce — Rights and Procedure

One of the most difficult questions in divorce is child custody. Parents are often in a dilemma — who will get custody, how will contact with the other parent work, and what rights do both sides have. In this article, we explain the rules for custody in North Macedonia.

How Does the Court Decide on Custody?

The court always makes its decision guided by the best interest of the child. This is not an automatic decision — the court examines all relevant circumstances:

  • Age of the child — For younger children, the court often favors the primary caregiver
  • Wishes of the child — Children over 10 have the right to express their opinion
  • Housing conditions — Where the child will have better living conditions
  • Financial stability — Each parent ability to provide for the child
  • Emotional bond — The quality of the relationship between the child and each parent

Joint Custody

Macedonian law allows for joint custody, where both parents equally participate in decisions about the child. This is only possible when parents have good communication and agree on key issues.

Joint custody does not mean the child lives equally with both parents — usually the child has a primary residence with one parent, but both decide together on education, healthcare, and other important matters.

Right to Contact (Visitation)

The parent without custody has the right to regular contact with the child. The court sets a visitation schedule that usually includes:

  • Weekends (every other or every weekend)
  • Part of school holidays
  • Holidays (alternating)
  • Phone contact

If the custodial parent obstructs contact, the other parent can seek court protection.

Change of Custody

Custody is not a final decision — it can be changed if circumstances change. For example:

  • The custodial parent neglects the child
  • The child expresses a wish to live with the other parent
  • Living conditions change

Advice for Parents

The most important advice is: put the child first. Divorce is a difficult experience for children, and conflicts between parents make it worse. Try to reach an agreement — it is better for everyone, especially the child.
